Data Processing Agreement

Provider

Party Wall Flow is the controller for its own platform records and processor for adjoining-owner data processed on behalf of surveyor account holders.

Roles

When you (the surveyor) use Party Wall Flow to process personal data of building owners, adjoining owners and other case participants, you act as the data controller and Party Wall Flow acts as your processor.

For your own account data (name, login email, billing details) Party Wall Flow acts as the controller as set out in our Privacy Policy.

Subject matter and duration

We process personal data on your instructions for as long as your account is active and for any post-termination retention period set out in the Privacy Policy.

Categories of data subjects and personal data

• Building owners and adjoining owners (name, address, contact details, dispute history, property photographs).
• Surveyors and other professionals named in correspondence.
• Authors and recipients of case correspondence.

Processor obligations

• Process only on documented instructions of the controller.
• Ensure persons authorised to process are bound by confidentiality.
• Implement appropriate technical and organisational security measures.
• Engage sub-processors only as listed at /sub-processors with 30 days' notice of changes.
• Assist with data subject requests, breach notification, DPIAs and audits as required by Article 28 UK GDPR.
• On termination, return or delete personal data subject to statutory retention.

Standard contractual clauses

Where personal data is transferred outside the UK or EEA, the UK International Data Transfer Addendum to the EU SCCs is incorporated by reference.
